Any advise for dealing with GEICO (Another guy hit me)

  • He has GEICO, and at the time i thought it was 100% his fault. Somehow GEICO is finding me at fault, and after i provided a mountain of evidence they still find me 80% at fault. I'm very confused by this.

    I live in a gated community (2 gates) and the rule is exiting vehicles yield to entering vehicles. The first gate has 2 signs up about it but the second gate doesn't because it requires a clicker to open so anyone using it should know the rule.

    Anyway, i pulled up to enter, stopped completely while the gate opened, then coasted in the gate. You cannot see anyone coming from the left at all until your head is inside of the gate line because of the big white fence up. My car got 2/3 of the way in the gate and a guy was not yielding so i stopped, he did not and hit my car.

    The gate then closed on the back of my car (Showing i wasn't even all the way in the gate when i stopped).

    I provided GEICO pictures of the yield signs, a copy of the lease which outlines the community rules including the yield rule, and pictures of the different angles showing i can not see him at all until it's too late while he clearly can see my car the entire time.

    GEICO is saying i should have pulled in more carefully (WTF?) and that because the yield signs are only on the other gate, not the one where the accident happened, that it is my fault.

    To me, this makes no sense whatsoever because I'm not sure how i could have pulled in any more carefully, and it seems clear to me that the gentleman who hit me needed to be driving more carefully and stopped when he saw me easing in the gate.

    Does anyone have any advise for dealing with GEICO? The rep is very nice but they seem a bit off base with how they are judging liability here.

  • Walk in, tell them that your lawyer will contact them. They might work with you a little more. Not sure how they could find you at fault with all that evidence showing it was the other driver's fault.

    Ask them what they think about the Casey Anthony trial.

    If not, Mountie is right. If cops came, it's pretty open and shut and Geico should do what they say.

  • This is the games insurance companies play...if your damages are less than your state's small claims court limits, tell them you're not going to accept the settlement and you're just going to just sue him personally. If you win, his insurance company will have to pay the damages and court costs.

    A good friend of mine is a lawyer, i'll ask him about it and see if he will rep me or suggest someone to contact.

    I took my car in for service one time at the dealership and the guy bringing it around wrecked it with another customer. The dealership offered to pay, the other customer was a 50-60 year old housewife who was freaking out, I had the cops come anyway. The cop pretty much said if they're offering to pay, I recommend you don't have us file a report, but good job having us called anyway. I made sure they gave me a loaner and a written letter stating they were fully at fault and would pay for everything before I left their lot.

    I called the cops and they said that because it was on private property they wouldn't come and that if i wanted to file a report that i needed to go into the station and file a post accident report or something like that?

    Sounded like they were just giving me the run around.

    I had a single car accident on private property (company I worked for) and the cops came out cause a bitch neighbor called them. They lied to you.

    This is where the urinating contest comes in. Different states have different laws. In some states, the police have jurisdiction for traffic offenses on private property, Most are a mixed bag, extending to private property open to the public in general, (think Walmart parking lot) or specific offenses IE reckless driving etc. Imagine getting a ticket for operating an unregistered/uninsured vehicle while you are checking the fence line on your ranch, for example...

    Consult with an attorney. Insurance companies are in business NOT to pay claims.

  • Bad news my man. He said you are SOL because there is no police report. The reason Geico isn't paying is because the other guy is telling a different story. If he was telling the same story, they would cover it.

    He said cops don't come out to private property because they can't issue tickets. If you are ever in that situation, you should suggest that the driver might be intoxicated, or the other driver is about to get violent, or something non-traffic related.

    Go to small claims court and sue the piss (max you can get in small claims court) out of him.

    Geico (and any insurance company) is given bonuses based on the # of claims that they save in money. It's usually a tactic they use to deny the claim at first. Once you go gorilla ball on them, they shut up and want to settle out.

    My buddy who plays on my volleyball team is a UT (Texas) alum out of law school. Spoke to him Sunday.

    He says he'll take my case. Not sure how serious he is about it but I'll bug him till he helps out.

    Anyway, I think I have enough evidence to win so I'll keep this thread up to date as I go.

    Also, interesting about the cop thing (saying he's intoxicated or violent). Good to know.
