  • My biggest issue is that should this go to the Supreme Court the way Roy Moore did, to go to the trial at the Supreme Court building, you wouldn't you have to walk past a statue or picture or something of Moses holding the same 10 Commandments? I heard that somewhere but I don't want to state it as fact without checking it. Either way, the hypocrisy of the federal government is mind-boggling at times. In some states, abortion is legal, but you can be charged with double homicide if you kill a pregnant woman (I know Minnesota has that law). So the humanity of the fetus simply depends on the mother's desire to deliver it?? Whether decisions like this go according to my beliefs or against them, I can live with it. Just please be consistent, which is never ever going to happen.

    Technically, the way things are set up, unless something is some gross violation of basic human rights, the Federal government is expected to stay TF out and States are to be allowed leeway to do things the way they choose, for better or for worse. That's the whole idea behind Federalism. By having this loosely united group of States making up a Union, we are given basically a group of States who customize their operations to their particular citizens' desires. We're also given the freedom to easily move from one state to another to find a place that suits us best (something that isn't so easy to do when you're having to look at moving to a new nation). As long as the Feds stay TF out like the Constitution tells them to, we get this great network of States offering, within reason, any flavor for any taste.

    That's what we should have. What we actually have is a group of States being dominated by a central government that bends to every little whine from every little bitch citizen which has come close to eliminating any choice we, as citizens, could have had. Big Government has stepped in and overruled everything which was spelled out in the Bill of Rights and made each State virtually identical to the next.

    Note, though, that this wasn't done legally in the Legislative branch, but illegally in the Judicial. Then to make matters worse, you have people like the ones in this thread who don't understand that SCOTUS can't legally make laws. Instead, they view the Courts as the major Legislative branch of our nation...then have the balls to call me a troll. I swear I feel like I'm living in a real life version of Idiocracy when I get into politics with most people.

  • Update: Judge will rule on County's request to dismiss suit, and ACLU's request for summary judgment in a few weeks. Suggested mediation and possible abbreviation of 10 commandments eliminating those with mention of God. They interviewed my preacher, I've known 30 years, and asked his opinion. Not county's but his. He said "As a preacher, I don't believe I have the right to edit the 10 commandments".

    Your argument that the 14th Amendment extends 1st Amendment restrictions to the States is no more valid than your initial stance that the 1st Amendment restrictions apply to the States on their own merit. What part of the ratification process and the introduction of the first ten Amendments are you not understanding that allows you to believe that they can ever be used to restrict the power of the States?

    Just as I began this argument asking if you had bothered reading the 1st Amendment, I now have to ask if you've bothered to read the 14th because, yet again, you're citing something that doesn't say what you think (hope) it says.

    All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

    This has been interpreted by the supreme court to extend the rights garaunteed in the bill of rights, including the separation of church and state, to the states. I'm sure you enjoy the right to a fair trial and due process that is extended by the fourteenth amendment. You can complain all you want to, but the other two branches of goverment recognize the courts right to interpret the law. The states seem to be in line with the Federal Government.

    You have every right to post the Ten commandments on private property.

    What you would have in a hundred years is a divided country that was at war with itself. After all, I can garauntee you there would be at least one Morman state, Catholic States, Baptist states, Muslim States, Hindu States, etc... We all know how well religious states and countries work out in the world. Be thankful for separation of church and state since this is what allows religious liberty to exist.

    Except that it doesn't. No matter how badly you wish it to be true, it does not at all mean schools can't display the ten commandments, lead prayers over the intercom, or do whatever the hell its students choose to do. The key here that you're conveniently overlooking is that the State cannot now and never will be able to limit what a student does on or with school property. The only cases where this has happened is when the ACLU or some equally ignorant left wing radical group forces a school's leaders to give in due to financial concerns and THAT is a violation of the first amendment.
