Colorado to legalize The Marijuana

  • duvalnole said...

I thought Colorado had already made it legalized, because the last time I was there back in 2001 I heard it was legal.

it was decriminalized up to a point.

    this is completely different

    why not.

Because it's a federal crime to have or use marijuana, and federal law trumps state law. However, they've been overlooking medical usage for a while now.

You people do realize that Marijuana is still going to be illegal in Colorado right?

    are you ALWAYS wrong?

  • Feds would have to start cracking down on everyone soon. Still got court battles too. Just the beginning.

well thats just stupid. SO what was the point. Was this vote just to make Colorado people feel like their voice counts. When really the Feds run our life no matter how we vote or what we say. Thats doesn't sound like a free country to me.

Feds have to enforce it. Also lawsuits.

while this is technically true, and will most likely be figured out by the courts, there are several approaches that can be taken by the state, if it has the will to.

it is legal in the state of colorado. If they state legislature passes a "fully informed jury act," then the juries in federal court will have to be informed of the state law and that they should nullify the verdict even at the federal court.

there are other things that colorado could do to stand up for its citizens, which would be fffking hillarious.

but, yes... the DEA could still look to prosecute, though it will have a tough time without local support.

federal law only trumps state law if the federal gov. decides to enforce. as of right now, the fed has taken a ignore stance to CO. and im pretty sure i watched a discovery show that interviewed a dea guy saying they would keep this stance in the future.

one way they are taking an indirect shot at medicinal growers and retailers in CO is forcing rules down on banks that do business with these people. so, say you own a medicinal retail shop.....there are many banks that can't give you access to an account for said business because they are not allowed to from a federal standpoint. try growing a business without a way to bank

The Big thing will be lawsuits, obviously the Feds won't crack down on people smoking a joint or something. I am not against it being legalized at all...IDK why anybody wants to do it, but to each their own. However, I don't like the way they are going about it Federal Law trumps state law, it is illegal in the United States, it may suck but it is the case. If Colorado can do as it wants with Marijuana, then Arizona should be able to do what it wants with immigration. Either states abide by all federal laws or they don't abide by any.

You're fairly right-leaning, are you not? If so, you should be in favor of supporting CO over the federal government, no?

Immigration is enumarated to the federal government. Don't recall anything about drugs though.

  • Legalize, sell and tax it and it will become less of a problem. Just like legal drinking age should be 18, make weed be 18. If it's legal there can be regulations on it and make sure it isn't laced with anything plus the tax would help fund Obama's out of control government spending.

I am in favor of states rights, including on this issue, but not this way. States shouldn't just do what they want and dare the Feds to stop them. There is a proper way of doing things. If states want states rights should should quit conceding them to Washington an get them back. But not violate the law.

Your argument against ignoring the Feds was that Arizona should be able to do it for immigration, but like I said, that because its enumerated.

We are way past enumerated powers in this day and age, unfortunately, and no liberal has any right to use it as an argument...so either federal law trumps state law or it doesn't.

And that states shouldn't try to usurp federal law. Enumerated or not, laws are laws, and either they are recognized or they aren't.

    sadly, you don't get it.

a federal law on drugs is clearly not enumerated, which means that it is not constitutional.

which means that it is not just

you're just mad that it is a republican law and it is illegal
