FSU may sue WVU

  • The Orlando Sentinel reporting.

    Honestly, as soon as FSU schedules 1 of the other 7 Big East teams that have an open slot this coming year, it will all be over.

    Everyone wants to take on the champion. 3-0 in lawsuits since 2007 is WVU. Bring it.

  • Called it. Not like we'll be wanting 50 mil or something. We'll sue for like 500K and court costs and WVU will likely have to pay it. FSU will be able to present pretty simple information that won't really be refutable. Who gets screwed is local businesses.

  • We wont have to sue. Its written in the contract that if WVU backs out they have to pay us, just like chickenshit Auburn did years ago. WVU will stoke us a check and not give a thought about welching and going to court where they would certainly lose.

    WVU is paying $500,000. The Orlando Sentinel said that FSU will be looking for an additional $500,000 on top of that. That wasn't the contract. There is a buyout clause in the contract, and WVU is paying that fee that is written in the contract. FSU would have no chance on getting more money from WVU.

    Still think its beyond stupid to cancel the home and home. Thank you senator Manchin! I hate that man.

    It would be ironic for FSU to sue when we were basically forced into the game as part of the settlement for swiping UM, VaTech and BC. Wish we could play. Both teams will be really good next year.

  • Frankly, I think we should sue WVU for more then $1 million. This is an unfortunate situation, overall. But, not entirely preventable from WVU's end.

    They've known for months they're going to the Big 12. They've known for months they needed to drop one of their OOC games. No need to put FSU in a position where we need to scramble to find a replacement team with only 7 months before the season even starts. Also considering the fact it'll cost FSU at least the original 500K to buy a scrub this late in the process to come to FSU. That game will also likely not sell-out.

    If you consider the damages to FSU, having to pay a replacement team north of 500K to fill the spot, lost revenue from the game likely not being a sellout, and consider the lost exposure (game would have been a nationally televised prime-time game AND College Gameday would have been there)... I think WVU may be on the hook for more in damages then what the contract states.

    As they should be.

    Can't argue with that. WVU should at least pay the 750K to bring in a replacement team.

    In concept, I agree with you. But it will come down to how the contract is written. If the buyout is framed as liquidated damages for cancellation of the game by one team, I would have to think FSU is screwed.

    Agreed. It very much depends on the writing in the contract. Hopefully this situation will cause FSU to more carefully word future home-and-home contracts with bigger programs.

  • You guys dropped a planned home and home with WVU in the early 90s for reason of moving to the ACC. Not sure how much notice you gave but it probably was not over a year. This happens when all this conference change stuff runs the show- its not the teams fault its conferences. Fact is we would never have never moved to the big12 if the ACC did not take Pitt and Cuse- and or SEC did not take TexasAM to restart all this madness.. if you want someone to blame for this blame the ACC and or SEC

    I would like to see this series take place at a later date but it probably wont for some time.

    FSU is entrenched in the ACC at this point.

    The ACC buyout is 20 million dollars now.
    The academics at FSU would be pissed leaving the acc for the big 12.

    The only place FSU or Clemson would leave for at this point is the SEC.
