HOA tells man he can't fly the American flag, so he does this

    I have to deal with HOA issues for my company. Had to send out a couple letters today to people in violation of our covenants. Flying any kind of flag is against our covenants as well. It has nothing to do with loving or hating America. It has everything to do with keeping the neighborhood looking good and keeping property values high.

    If we allow one guy to fly an American flag, we cannot keep another guy from flying an Iraqi flag or another kind of flag if he wants to, that's discrimination. The only way around that is to not allow any flags, signs, etc. Otherwise, our neighborhood could be blanketed with all sorts of nonsense and make it look like shit, not to mention hurt our sales and property values.

    If you don't like it, don't live here. The covenants are clearly explained to everyone who buys here. Nobody is tricked into anything. If you want to fly an American flag, do it inside. Why do you HAVE to show it off to everyone else?

    For the record, the HOA where I live is the same. I don't mind it. I don't need to fly any kind of flag to express my feelings. I do think the guy who painted his house like the flag is hilarious though.

    Here's what the answer to this should be, "YOU WILL NOT FLY AN IRAQI FLAG IN THE UNITED STATES OF AMERICA PERIOD"!! Oh and I agree with your statement, though not in the way you intend, "if you don't like it, don't live here." Meaning if you don't like my American flag, don't live in THE UNITED STATES OF AMERICA!!! Moreover, if you don't love it leave it.... btw, you are a very stupid person!

  • I've never lived in a subdivision that bans flags.
    However, I have seen covenants banning flag poles in yards.

    What city/state was the story from?

    Down South (greater Atlanta area)... just about every home has a college flag hanging out from within the PUDs.
    However, erecting a flag pole requires permit, HOA approval/exception, etc.

    The HOA can do whatever they want. But enforcement has to be strict otherwise it gets thrown out in court for not being evenly enforced.

  • The federal Freedom to Display the American Flag Act of 2005 prohibits the HOAs from doing this. They can prohibit size and the placement of poles (due to noise). That being said, this guy is a tool. You have the right to buy property anywhere you want to. If you do not want to be subject to the laws of the HOA, don't buy property there. If they try to enforce an illegal rule, there are ways to deal with those actions that do not once again violate any rules. You can tell them its illegal and threaten to take it to court, or just take it to court, you can call the press, you can file charges against them for breaking the law. But you don't have the right to lower your neighbors property value, or cause them to have to look at such an unsightly mess. You signed a contract saying that you wouldn't. Sure, the HOA has over extended its authority. They do that. That is why we have a system in place to deal with this sort of thing. Painting your house like that is just juvenile and will alienate your neighbors. Grow up, stop being a passive aggressive shit head, paint your house back to normal before you get kicked out of the neighborhood and put your flag in your yard.

    Yeah, this is just bad management. Due to the federal law hoa's really can't prohibit American Flags, nor should they be able to. I manage a lot of hoa's and this has come up several times, just pretty much tell my clients this is something they can't touch.

  • Actually I have a question about this and it has nothing to do with flags and so forth. What if someone buys a home and the neighborhood later decides to become an HOA organized neighborhood? Is that something that has to be decided by the original landowner before he even starts selling property or can it come afterwards? I do a little in land development and the original owners of the land set it up as an HOA property when I start laying out sedimentation & erosion control plans, stormwater plans and so forth but does that have to be done prior to selling the lots?

    The reason that I ask is because if it can happen afterwards what happens to people that didn't sign a HOA agreement before they bought the property and built on it. If they can come in later and start telling people what they can and can't do after they have already purchased the property just doesn't seem right. I would assume if HOA's can pop up after a person has already purchased and built in a neighborhood that they would have to have a "grandfathered" in clause right would they not? I have a friend who's HOA is getting on his ass because he has a satellite dish on the side of his house and they are telling him that he can only have it on the back of the house. Makes no fvcking sense seeing as though Satellites have to be set up in a certain direction to pick up the signal but he's been there for six years and it's just now an issue.
