Is it legal to drink and drive in a gated neighborhood?

  • It is considered a private street. If you mapquest it, it shows "private street". Does that mean it's ok? Serious question.

    Legally? No

Do I have any issues with it as long as you aren't belligerent? Absolutely not

^This seems like a fair assessment. Although, in a gated community I'll say that "belligerent" is definitely a relative term.

  • I say no and I have a big problem with it. Considering there are possibly children playing in this neighborhood. There is never any reason to drive while or after drinking.

I'm not drunk. I just popped open a beer in my neighborhood and started to get paranoid that if a cop happened to come to where I'm parked and see the open container, would I be in trouble? Do cops have the right to cite me? It's not a public street.

If they're douches they can cite you for open container

I don't care. Even if your reactions are slowed by only a split second that might be enough if a child runs out in front of your vehicle.

Do you pay city or property taxes? I would assume that means you're in some cops' jurisdiction.

LOL, of course u don't care. Just keep finding a way to bash me whenever u can, in any thread. 1 beer is not affecting my judgement but ok. If 1 beer affected judgement, the legal BAC limit would be .01.

No security guard. 1 state trooper lives in the hood but no cops (we're in the county-not city) ever come in here.

  • My parents live in Greystone and the "cops" there are Nazis. They actually sit in their electric cars and try and get speeders. If you get caught speeding, your name goes in the newsletter. lol

My point is why risk it. If you think I am bashing you then you are mistaken. I am not targeting you. I just disagree with you on just about everything.

I would say the same thing to anyone who created this thread that I am sure you knew the answer to before you ever started it. Anytime you are on a public road it is illegal to consume an alcoholic beverage while operating a vehicle.

  • After reading that the general consensus seems to be yes you can get charged. The better question is, why risk it in the first place? Why cant you wait till your at home or in a bar?

What opinions have I had that u disagree with?

You've stated thru pm's that u judged my other thread titles without even reading them. So, other than this thread, what opinions have I given that you disagree with to say 'I just disagree with you on just about everything'?

And your prejudging has you incapable of seeing clearly. I honestly do not know the answer. I did not start this thread knowing the answer. I know on public streets, the answer is no. The fact this is considered a private street has me curious as to the law. I'm sorry you can't get past your distaste for me to see things how they really are. I think I've started one troll thread since I've been here. I don't make up stuff to be cool or get attention. I post real things and yes responses are desired. That makes me no different than anyone else posting info or questions.

I just disagree with a lot of opinions I have seen you give. I don't have specific examples. It is not a big deal. I disagree with a lot of people and I am sure there are plenty that disagree with me.

I just assumed that anyone would know that you can't consume alcoholic beverages while driving on a public road. I apologize for jumping to conclusions.

Still to my initial point. Why even risk it?

It's not a public road. I visit neighborhoods all day b/c of my work and they are public. This is considered a private street.

That is one thing we can agree on, it was stupid to even risk it. No argument from me there.
