    No. Employer's can check your references or ask to talk to family members or whatever else they want. If you don't agree, they don't have to hire you.

    Well... it's already scheduled to go to arbitration, so yes - it is a lawsuit waiting to happen unless it gets resolved at arbitration.

    She might get a token payout just so the school can avoid paying attorney fees. But... this facebook thing is a touchy subject and as of now it's likely OK to terminate if the employee is "at will."

    I don't think the facebook password thing is a big deal. She was asked to do something and didn't do it. If she's "at will" and the firing is non-discriminatory, the employer has a lot of ways to terminate.

    I didn't mean it to come across as "not a big deal" for them to ask for it. I meant that, right now, it seems like the termination isn't a big deal when the employee didn't do what she was asked to do.

    As I mentioned earlier, this facebook thing is a touchy subject. Personally, I make sure my facebook is clean of any of that crap.

    I completely agree man, but what happens when they start doing it to everyone? I for one will not give them my password, it's a slippery slope. She had business having that picture up with the proffession that she does.
