    But, the point of this execution is that the man was NOT denied access to the Mexican consulate. This case has been under appeal for a while in one venue or another. What the article did point out is that what the state did not do is come out and suggest to him that he contact the consulate. So, if an American were not allowed access if they so chose it would not be the same thing. This individual was not turned down because he never asked.

    He hand been in America since he was two years old!!!!!! Why would he need a consular when he has been in America his whole life?

    Because he had lived his entire life in America. His family brought him here when he was two years old. He didn't think in the farthest of possibilities in his savage mind that he could contact a consular because he was "American" after living here for all but two years of his life. This was more of a shot at the death penalty that some BS international treaty. It was a political statement by the spineless left, that's all it was.

    International treaties do not take precedent over aspects of government that are a state's jurisdiction rather than that of the federal government. To let that occur would make an aspect of state jurisdiction into a federal one.

    He will never understand the role federalism. I bet he couldn't give you two coherent sentences on the history of selective incorporation, much less state jurisdiction. BTW, there was nothing Perry could do. The Texas Constitution forbids unilateral clemency or pardon. The Texas Parole and Pardon Board would have to recommended this case to Perry; they did not, so he couldn't do squat. SCOTUS ruled the legal argument was based on the prediction of what legislation might produce. If you even studied Constitutional Law for thirty seconds you know that the court doesn't operate on hypothetical legislation. Obama and his people presented a weak legal argument and it was shot down by the sane members of the SCOTUS. It was a political ploy against the death penalty, pure and simple.
