The new bill simply was to get in accordance with a treaty that was already signed and ratified years ago. I understand the supremacy clause was answered previously, which is why I'm knocking stare decisis because I disagree with those decisions. I think this goes right back to the clause, because you shouldn't have to have a bill to be in accordance with a treaty you agreed with anyway.

You still overlook that you cannot have a treaty that takes away powers enumerated to the states.

I am still waiting for a basis as to why those decisions are incorrect.

Those decisions have stated that the constitution gives powers to the states.,Ruling otherwise, that a treaty can be made to override those powers, takes away powers given to the states and therefore is not valid against the states.

    Questions for you all...

    1. What about prewithdrawl obligations?

    2. Again, why does a state not have to inform a citizen of another country about it's legal rights under international treaty's signed by the government it's under?

    3. What happens if an American is in the same situation? Should they not be afforded these rights?

    4. The conviction was 16 years ago, yet the execution can't wait two months to make sure it's in accordance with an international treaty we signed?

But the Supremacy Clause in Article 6 overrides the states usage of their 10th Amendment rights.

    1. What about it?

    2. A state is required to operate its criminal system within the constitution or its verdicts will be overturned. IOW, the constitution states rules regarding search and seizure, therefore failure to follow them can erase a conviction because a constitutional right of an individual was violated during his trial. There is no constitutional right of an individual to be informed that he can ask to see his consulate.

    3. I don't care if a country does not INFORM an American that he CAN contact the American consulate.

    4. It has nothing to do with waiting to make sure it is in accordance with a treaty we signed. That question was answered in 2008.

Liberal playbook: can't argue with precedent and legal jurisprudence, resort to calling someone racist.

Fact is a man paid the price for raping and stabbing a sharp object into a 16 year-olds vagina before bashing her skull in with a 30 lbs chunk of asphalt. The mentally sane people of the SCOTUS provided a clear and coherent legal opinion based on common law precedent established by prior courts. They refused to make legal rulings based on majestic laws or hypothetical legislation that doesn't exist.

    New day, more +1's.

Who said anything about the guy going free?

So, it went from Obama attempting to delay an execution (for an idiotic reason) to... liberals crying and trying to get him to go free? Or as josh1976gator claimed, people supporting the offender?

I guess I'll never understand why people need to become so political during political discussions. Because when that happens, the first thing to get tossed out the window are typically the facts.

More like a weird form of white supremacy where he wants all america to join white culture.

Anyway, it's official - the UN has ruled that the US broke international law. I would remind everyone that the point of international law is to protect people from foreign nations.

This discusssion has become completely absurd. The man who was put to death is meaningless - the only reason the president objected was because he thought Texas was breaking international law - which they were. if you want to argue that we shouldn't care about international law fine, thats completely different from what thee president was bring accused of here. He wasn't protecting anyone except Americans abroad.

Argue that the law is dumb if you want, don't argue that obama was trying to protect a murderer. It's 100% wrong.
