I'm well aware of the Supremacy Clause. I used the word "seized" incorrectly, which is probably what caused confusion over the intent of my post. My point was that Holder stopped federal raids on medical marijuana, which is a contradiction of federal law.
That said different members of the administration will have different views on the subject, so its understandable that there's a discrepancy within the administration. Just seems though that this issue is all over the place within our government. Liberal legislators seem to approve of medical marijuana more than conservatives, while it was the liberal Supreme Court Justices that ruled against it (in order to preserve the current interpretation of the Commerce Clause). Then the administration backs ending these raids, and turns around and nominates this lady for head of the DEA. Just weird, but it's all a political game.
