Doubtful. If there's one thing we all know to be true about how the Senate and the House work, even if supporting or overturning a bill is a good idea, those of the opposite party will do everything in their power to stonewall the process and vote accordingly. Which is sad, because I'm almost positive it hasn't always been like this.

To completely repeal, you'd likely need 60 votes in the Senate. I think the GOP will take the Senate, but not the filabuster proof 60 votes and I know there will be at least 1 or 2 Dems willing to FB to block any repeal.

The easy way is to kill all funding for it, the house controls the budget (initially, must pass through Senate and signed by Prez). I think this is the likely way that it will be crippled (strangle it financially).

Now if Romney gets elected and things strart to turn around, maybe the GOP can get 60+ in the mid-term elections. I haven't looked at which Senate seats are up in the 2014 mid-term, so I don't even know if that is possible.

Good point. Declaring it a tax was a double edged sword for the Dems. A simple majority in both houses and the oval office is all that is needed to repeal this.

BLF, I think you are being a bit homerish. We will see in a couple of weeks, but right now I would not put a $1 on Obama winning. He is behind in the RCP electoral map (average of all of the polls). In the Gallup, Romney is ahead of where each of the winning presidents were at this time in their campaign all the way back to Carter in '76. I know I am a bit of an anti-homer here (more anti-Obama than pro-Romney), but I really don't think Obama is going to be in the Oval office after this January.

As for the senate, 42 of the GOP seats are safe, to only 37 for the Dems. The remaining ones fall under leans or toss-ups. I don't think either side will get much more than 50 and certainly not the FB proof 60, but I wouldn't bet much on a Dem setate either.

Again, these are polls which is a subset of statistics. As we all know, there are 3 kinds of lies: lies, damn lies and statistics (thank you Mark Twain). With that in mind, I wouldn't be too sure of an Obama re-election or Harry contolling the Senate come next year.

Budget Reconcilliation wouldn't repeal it. It could only send the bill to a subcommittee to amend part that could be agreed upon.

Since the legislation will be enforced by the IRS, Romney's Sec Treas could mandate that the law NOT be enforced.
