Arkansas had to fire Petrino and Marshall was right in saying so. They would have faced numerous lawsuits if they would have kept him and it probably would have cost them more in the long run.
Auburn doesn't have that issue with Petrino. If they hire him, they just have to hope he doesn't screw up like that again. It doesn't come down to a legal issue in their case.
Petrino didn't kill anyone, he just broke the state law and school policy in a hiring process. Auburn or Arkansas are in no position, nor should they, to play St. Peter and the gates to Heaven. The issue is the law and Petrino has broken none at Auburn, so other than some public relations issues that some folks will have to deal with, there shouldn't be an issue in hiring him, unless the school doesn't want to deal with those issues.
Honestly, the positives out weigh the negatives, IMO, if that is who Auburn feels is the best possible candidate.

The difference is that Alabama has never claimed moral superiority. We know that we aren't Lilly white but never claim to be.
On the other hand AU constantly tells everyone that will listen that they do things the right way and that their fanbase is the greatest Christian coalition to gather under one banner since the crusades.

The bottom line is that Marshall put his foot in his mouth 7 months ago. Now after witnessing a 49-0 beat down, Petrino is a good man worthy of a second chance..Get real
