The Death Penalty(Criminal Justice)

  • In the state I live, we do have the death penalty as an option. In a death case, when we pick juries, all potential jurors who do not believe in the death penalty are automatically excluded. All potential jurors who believe in the death penalty but personally have any reservation about being able to impose it themselves in the right case are also automatically excluded. Therefore the only people who are even eligible to sit on the jury already believe in death and agree they could impose it in the right situation.

Now, the last 10 death trials I know of here, all 10 times the jury has convicted the defendant as guilty of murder. In all 10 the special death eligible jury chose life in prison over death.

    Yeah, that pesky little problem.

Against it. Sentencing any innocent person to death is not worth the marginal benefits of killing evil people. Just do what Russia does and keep them locked up in a room with nothing to read, watch, listen to, or really do anything except stare at a wall for hours that turn into days, days that turn into weeks, weeks that turn into years, and eventually a lifetime filled with a blank void.

I take it you have seen russias toughest prisons?

Yeah, crazy stuff. That's way harsher than pumping toxins into a man's veins. Let him sit and look at a white bricked wall for the next 20, 30, 40 years.

Shit, I get bored doing just about anything after a while. I can't even imagine what it would be like to be trapped in an 8x10 cell with a bed that I can't lay in unless I'm sleeping. Just crazy to even begin to think about.

Well, certainly not jail but a federal prison would suffice.

I still think that the death penalty would be good. But yeah, if we could actually have things like that in american prisons i would love it. People would be truly afraid of those prisons.

Yeah, prison is fine. Don't let then have the luxury to die early... Make them suffer...

  • IMO, the death penalty is only a fitting penalty if the criminal is afraid of death. Personally, I don't think a lot of these menaces are and I think some even desire it. I say, assuming we can drop prison costs, let 'em rot to death in solitary confinement.

I'm surprised no one has mentioned the importance of the economy and it's correlation to crime. In addition, public policy. I find the prohibition of alcohol and drugs eerily similar. The funny thing is that one has ended, while the other continues to fill our prison with minor offenders, fuel drug money out of the country, waste taxpayer money etc.

Probably because the discussion is about the death penalty, not all of the worlds woes. Not a flame but your the guy who asks a question in which you already have a rebuttal.

It's all connected. I know a lot of people who see the DP as a means to free the tax burden from prisons etc. or lowering crime rate by increasing severity of the punishment. Crime is a complex phenomenon. I don't think it's as black and white as just quickening up and/or increasing the usage of the DP. I really enjoy these discussion threads and I think it's a good way to see how multi-faceted the problems we face and the solutions we have are. Maybe someone changes their view on the DP afterwards whether pro- or against.

No not all, I don't see it as bashing. Good, reasoned debate is what this country is founded on, and the question of Justice is one that has been debated for a long as man has been around. My reason for being against the death penalty is because of the 8th amendment. If we consider murdering another human so heinous and cruel of an act to warrant the death penalty, then how can we not consider state sanctioned murder cruel as well? Plus I hardly think it works as a deterrent to murder as well.

Anyways my argument is far from perfect, but it's what I believe and I realize it is contrary to the majority of this country.

Nothing cruel about putting an animal down, imo.

One thing that I feel would help make the death penalty a deterrent is if it was consistent. Putting down every single one of these animals may prevent another from doing it. If it saves one young child from being raped, it is ok in my book.

This. Expand it to include rapist and child molesters also.

Amen to that, you rape someone and all they do is stick you into protective custody with a bunch of other rapist so you don't get hurt, the death penalty would be to release them into general populations and let them know why they're in prison, they'll take care of the Justice after that. I agree with the death penalty now that they can use DNA evidence, way to many people were put in prison who were innocent but DNA evidence sure helped to alleviate that a lot.

They could at least have a chance to get out one day and I'm not generalizing every conviction of murder. The example I gave is from Russia and it is for some terrible human beings. One guy killed some people and started eating them and selling their body parts.

I'm not a scientist but this is an example of the "CSI Effect". DNA evidence won't help anyone convicted on circumstantial evidence.

I wonder if PETA is ok with that.

  • For it....after convicted person has been imprisoned for at least 10 years...UNLESS there is obvious evidence (ie. admission of guilt, witnessed by multiple non-biased persons) then I'd be for an earlier execution. There are too many people that have been wrongfully convicted and eventually exonerated to move haphazardly to quick executions.

I know (knew) one person that has been executed and another that is currently on Death Row. So perhaps my perspective is affected by true experiences.

Plenty of people that spent many years in prison have been released because of DNA evidence that was recovered years ago but the didn't have the technology to use it.
