the problem with that is that the company needed to do the testing.

that is their job in order to avoid the liability of a harmful product. so, the people that bought them first should have checked facts that don't exist?

it falls on the producer of a product to check their claims and to make products that are not harmful. Take the movie "the jerk..." when someone produces a product that they have not tested thoroughly, they often open themselves up to torts.

a company that comes out with a new product needs to test that product. most of the lawsuits in this country could be avoided with prudent action.

sketchers really fucked it up with that one... i mean, shit... i understand the desire to release a new product, but it is a risk, especially when it is as untested as their stupid shoe.

they didn't advertise it with a use at your own risk warning or anything, they advertised it as safe, and theraputic.

what would you do if some company released a product for you, that would supposedly fix your ankles or something, and it turned out to be more harmful than good, and they didn't do enough testing?
