Thoughts on this NCAA letter to Miami

  • I don't agree with them using the word of a convict as fact if someone who isn't required to talk to them doesn't talk to them. confused They should only be allowed to use what they can prove. But the NCAA thinks they are Roger Goodell and do what they want.

    They are asking for the word of the other side of the story and obviously aren't getting it. If you have nothing to hide then talk to the NCAA. He said it now defend the position or suffer the consequences. Not real hard to understand.

    NCAA is giving UM and the players every chance to tell their side of the story. If they refuse, then what do you expect the NCAA to do? They only have one side of the story because they other side refused to talk. That is admission of guilt.

    The hammer will be dropped.

    Shapiro is a witness. A firsthand witness with documentary evidence. The NCAA is entitled to believe what he says. And this is not extortion. If it were, the Miami-Dade prosecutor or Florida AG would be stepping in to prosecute someone. This is the NCAA telling witnesses to come forward or forever hold their peace because the NCAA train of corrupt justice is about to leave the station without them. Is it sleazy and a bully tactic? Absolutely. Is it further proof that the NCAA really doesn't care about getting to the truth but just intends to do whatever the frick they want in each situation? Absolutely. But we already knew that. If they at least had to follow some reasonable set of rules, maybe it wouldn't be so bad. But post the PSU situation, they don't. Rules don't apply to the NCAA. They are free to do (or not do - see UNC academic scandal) whatever they want.

    They can use the evidence provided by the players that had to talk. Not the ones that by NCAA rules didn't have to talk. You shouldn't be able to convict using evidence that doesn't exist or something you can't prove. Is all I'm saying.

  • I am pretty sure I have seen credit card receipts where Shapiro paid for certain items/services. If those are legit, there is a burden of proof/disclaim on behalf of the players to disprove that the items/services were not for the purpose noted by Shapiro.

    I would think if the allegations were false and the players wanted to clear themselves and their U of wrongdoing it would be pretty simple to talk and tell NCAA this guy(shapiro) was BS.

    I don't blame you. It sucks. I can't believe the presidents of the major schools are willing to put up with this crap. Miami almost certainly violated a ton of rules and deserves to be sanctioned, but it should be done via an honest and ethical process and not at the whim of a corrupt dictator.

    Everyone applauded when they threw out the rules when dealing with PSU. Now it's your turn. I hate to say I told you so, but I told you so. Don't worry though. I'm sure Mark Emmert is a man of honesty and integrity. It should all work out just fine.

    This is spot on.

    And to the people saying PSU's situation was worse - you're right. But what does that matter? NCAA will do what it wants to. Who exactly is going to stop them?

    If you throw out the rules in one case and everyone lets them, then what is going to stop them from doing it in other proceeding cases?

  • That's the way our legal system should work. Hey we have these concerns and this person is saying that you did this, We looked into it and we have our suspicions. You have chosen not to respond in any way shape or form for help us with this investigation if you continue to do so we will assume that you are guilty.

  • Both things are true:

    1. Miami is in deep trouble; and
    2. Regardless, someone needs to put the NCAA in their place, they are out of control.

    NCAA will try to pull a PSU on Miami--"agree and consent to punishment "A" or we will really make you pay." Hopefully Miami does not wilt like PSU and puts up a fight.

  • Interesting article. The only thing I disagree with is that I don't believe for a moment that Mark Emmert's "heart is in the right place". He's incompetent and corrupt. But the net results are equally bad, so it really doesn't matter which you believe.

    The NCAA is wanting to talk to every player involved, which evidence was provided. If they don't come foward with evidence suggesting Shapiro is lying, then Miami will get what they deserve.

    If this were court and the state has evidence that you are guilty of a crime and the defendant has no rebuttal, then you are presumed guilty.

    I know Miami fans are upset, but I fail to see where the federal court comes into play here. NCAA has one side of the story. They are giving the other side the chance to make their case known as well. If they refuse to talk, they are admitting guilt.

    What is the issue here that Miami fans are seeing? I honestly have no idea, that is why I keep asking.
