Thoughts on this NCAA letter to Miami

    Don't care. All I ask is, what did I say that was moronic? What was G&G hued? Explain to me why you dont look like a fool for thinking you and your meager minded fan base out-thought the NCAA in the legality of their actions.

    You won't answer, you'll just vaguely flame me again with crap I dont care about. Like your opinion of me personally. As if this is really "me". You claiming to be objective reveals how dumb you really are.

  • Reggie Bush was no longer in college, yet USC still took sanctions because someone not even affiliated with the university gave him and his family benefits. He also gave back the Heisman. Where were he lawsuits there?

    They don't have to talk though, the NCAA is trying to force them too. I would think a player could sue the NCAA for defamation of character if damaging things about them came out from the NCAA since they are not required to participate in the investigation like the current players are. That's the lawsuit I could possibly see coming out of this.


    How much would the players sue for? In a defamation case there must be an amount that was injured due to the defamation. The player will be required to show specific evidence on how the NCAA's slander cost them money. If they are successful the NCAA will have to pay the money. However, they will still have the sanctions in place.

    The thing that everyone is having trouble understanding is that the NCAA isn't going to list out what it finds, but only its judgement/sentence. It will be something vague such as... "For impermissible benefits for up to some number of players". If Miami decides to challenge this by way of legal system, then you might as well expect these players to testify then. If this happens Miami better hope it is squeaky clean, which we already know is not the case.

    And to the people saying PSU's situation was worse - you're right. But what does that matter? NCAA will do what it wants to. Who exactly is going to stop them?

    If you throw out the rules in one case and everyone lets them, then what is going to stop them from doing it in other proceeding cases?

    Technically, we should blame your administration. They stipulated to the process, thereby creating bad precedent for everyone else.

    Had your administration had the sack, it would have self-imposed the death penalty or something similar prior to the NCAA having to move based on the Freeh report. Then, there wouldn't be bad precedent out there.

    However, the last thing in the world that PSU fans have to complain about is the NCAA throwing out the rules and procedures since they agreed to allow the NCAA to break the rules. They brought it on themselves out of fear over a potential multi-year death penalty.

    No, he's right. Legally, an unrebutted argument is taken as true. If you don't think so, try getting sued and then not showing up to the trial. Not likely to work out too well for you.

    If there is only one story told to the finder of fact, then it's pretty easy to decide who is right.
